An Airman Basic at Sheppard Air Force Base, Texas, needed our assistance in responding to his administrative separation.  The administrative separation was initiated due to allegations of drunk and disorderly conduct and assault allegations.  These allegations occurred within merely two weeks of each other.  After the Airman successfully completed his punishment and advanced training, the command initiated the administrative separation.  The Airman retained our services to assist him in responding to the administrative separation.

During the Article 15 proceedings, the Airman’s command refused to allow the Airman to view the video footage wherein he allegedly committed the assault.  We successfully advocated for our client and us to view the footage.  The video footage revealed that our client was NOT the aggressor in the assault allegation.  It appeared that the command had not even viewed the footage. Additionally, we interviewed witnesses that were seen on the footage, who witnessed the entire event, and who were not interviewed by the command or the military police.

Because of our successful advocacy, relentless investigation into the allegations and pressure on the command, the Airman was retained in the Air Force and allowed to move to his first duty station.

Result: NO BASIS TO SEPARATE, RETAINED!
