Our client was accused of distributing an illicit sexual image of an individual that he had a previous sexual relationship with. We thoroughly investigated the case. We were able to show that the alleged victim had motive to fabricate the allegation because our client testified in a trial calling her a liar. The case itself was 3 years old and the timing of the allegation was convenient for the accuser. The other key to this case was the fact that the image in question did not exist. There was no image in the evidentiary packet. In fact, the government’s own evidentiary packet showed that our client merely described an image he had received not that he had distributed any illicit image. Our client was exonerated.
