U.S. Air Force v. LTC
Our client is a highly esteemed Air Force Medical Doctor. One evening, he and his neighbors held a celebratory dinner. At the conclusion of the dinner they had some after dinner drinks. Our client walked home with a neighbor to get his dog. A little bit later he slipped away from the party and started to walk home. The alleged victim was also a neighbor; however she was NOT invited to the party. She was known in the neighborhood as an untrustworthy drama queen. She happened upon our client as he was walking home. She alleges that as she was assisting him on his walk him, he was groping her. After they arrived at the front porch, she asked him if he was going inside or going back to the party. What an insane thing to say to someone you allege is groping you. According to her, he wanted to go back to the party so she helped him back.

After assisting him back to the party, she left. She returned a little while later with kids alleging that my client had sexually assaulted her.

Multiple individuals at the party saw them walking away together and saw them walking back together. He was not groping her. She was laughing and having a great time.

So, with all of the eyewitnesses, one wonders how this turned into a case. Later on that night the police showed up at our clients house. In his drunken state, he was questioned. He was asked if he touched the woman and he said he did.

Careful investigation into this case by the Defense team uncovered the fact that our client is a very agreeable person. He goes along to get along. He avoids conflict. That night he was drunk and not thinking clearly. Despite his so called “confession” eyewitnesses observed him with the alleged victim. They also observed that he was highly intoxicated. Even if he did touch her, he had no specific intent to do so. Ultimately the board saw this case for what it was. The local authorities dropped the case against our client and the board found no basis to separate.
