(Army ROTC Cadet – Green to Gold)
Accusation: Sexual Harassment
Our client was a Green to Gold Army ROTC Cadet accused of sexually harassing a fellow female cadet. We were brought on to challenge the investigation and file a rebuttal action against the disenrollment proceedings.
In this case I gathered several witness statements. Those witnesses, though known to the investigating officer, were not interviewed by the investigating officer who made negative findings against our client.
What we learned through our interviews is that the alleged victim in this case was actually the one sexually harassing our client. Shockingly, he was not the only male in the class she was harassing. She sent a variety of sexually explicit messages to my client and at least one other male in their class. She was also quite interested in our client. After he rejected her overtures, she claimed sexual harassment.
The sitting primary military instructor for the school thought the female Cadet in question walked on water. He did not consider any alternate facts in this case.
After we thoroughly investigated the case on behalf of our client, I drafted a lengthy legal review outlining all the issues and problems with the veracity of the evidence. We also provided the statements I gathered.
Ultimately, our client was allowed to go back to class this semester as we were able to convince Cadet Command that the investigation was not legally sufficient to support a disenrollment of our Cadet client.
Result: RETAINED!
