WHAT ARTICLE 128 (and 128b) COVERS

Article 128 — Assault

Under Article 128, a service member can be charged for:
  • Attempting or offering to apply unlawful force or violence against another person.
  • Actually inflicting bodily harm (battery), even if no weapon is used.
  • Aggravated assault — using a dangerous weapon, or means likely to cause death or grievous bodily harm, or assault inflicting serious injury.

Article 128b — Domestic Violence Specialized

In 2019, Congress codified domestic-violence offenses under 128b to close gaps in prior assault laws. 128b applies when the alleged victim is a spouse, intimate partner, dating partner, or immediate family member.

Violations may include violent acts, threats, intimidation, violating protection orders, strangulation or suffocation — all punishable by court-martial.

Punishments & Consequences

Penalties under Article 128 (and 128b when applicable) can include:
  • Confinement, reduction in rank, forfeiture of pay and allowances.
  • Bad-conduct or dishonorable discharge, forfeiture of benefits, loss of security clearance, and severe long-term consequences on civilian life.
