WHY IMMEDIATE DEFENSE MATTERS
When you are accused of assault or domestic-violence under Article 128/128b, investigations and command pressure begin fast. Statements, evidence collection, command influence, and rush to prosecution can destroy a career before a defense is even built.
Do not speak to investigators, command, or anyone else before talking to an experienced military defense attorney.
Joseph Jordan steps in early — protecting your rights, preserving evidence, and building your best defense from day one.
WHAT ARTICLE 128 (and 128b) COVERS
Article 128 — Assault
- Attempting or offering to apply unlawful force or violence against another person.
- Actually inflicting bodily harm (battery), even if no weapon is used.
- Aggravated assault — using a dangerous weapon, or means likely to cause death or grievous bodily harm, or assault inflicting serious injury.
Article 128b — Domestic Violence Specialized
In 2019, Congress codified domestic-violence offenses under 128b to close gaps in prior assault laws. 128b applies when the alleged victim is a spouse, intimate partner, dating partner, or immediate family member.
Violations may include violent acts, threats, intimidation, violating protection orders, strangulation or suffocation — all punishable by court-martial.
Punishments & Consequences
- Confinement, reduction in rank, forfeiture of pay and allowances.
- Bad-conduct or dishonorable discharge, forfeiture of benefits, loss of security clearance, and severe long-term consequences on civilian life.
We have successfully represented Servicemembers of all ranks, (enlisted and officers) against allegations of domestic violence and assault. Our cases include successful defenses against allegations of domestic violence made by spouses, girlfriends, boyfriends, and children.
