"Ei Incumbit Probation Qui Dicit."

Proof lies on him who asserts, not on him who denies. The concept is that one is innocent until proven guilty. Regardless of what the law says about reasonable doubt, there is an unwritten presumption within the ranks of the military that if you are charged with sexual assault, then you are guilty. The stakes are your life! Your military counsel works for the same military that charged you. Consider that as you choose who represents you in your potentially life altering case.

Our Firm Helps A Client Gets His Wings Back

In a case which is still pending, a client of Joseph L. Jordan, Attorney At Law has had his flight status restored. Our client was one of three Air Force instructor pilots who were grounded over a series of text messages they sent which referenced drug use.

A Painful Misunderstanding

The text messages in question referenced “Molly,” a form of the street drug ecstasy, but in the context of lyrics from popular songs such as Miley Cyrus’ “We Can’t Stop.” The Air Force saw this as evidence that the pilots were engaged in distributing drugs, and promptly stripped the pilots of their wings while they awaited further consequences.

Congressional representatives Duncan Hunter and Adam Kinzinger quickly took the side of the pilots, adding that these references were “painfully misunderstood by investigators.” They proceeded to urge Air Force Chief of Staff, General Mark Welsh, to investigate the matter further.

Justice For The Pilots

Last week, the Air Force issued a release which stated that the allegations of misconduct were not “sufficiently substantiated by the evidence,” and as a result the pilots wings were returned. This decision comes more than 9 months after the pilots were initially punished, but reason ultimately prevailed. Two of the Airmen still face potential punishment related to other “conduct unbecoming of an officer.”

The Airmen are lucky that Reps. Hunter and Kinzinger helped them pursue justice. As a Marine Corps veteran and an Air Force veteran, respectively, Hunter and Kinzinger understood the very serious penalties the pilots were facing. The two “remain concerned… with parts of the military justice system” and have stated that they will work to address these issues.
