Ei Incumbit Probation Qui Dicit.

Proof lies on him who asserts, not on him who denies. The concept is that one is innocent until proven guilty. Regardless of what the law says about reasonable doubt, there is an unwritten presumption within the ranks of the military that if you are charged with sexual assault, then you are guilty. The stakes are your life! Your military counsel works for the same military that charged you. Consider that as you choose who represents you in your potentially life altering case.

CID: The Investigative Branch of the U.S. Army

Criminal Investigation Division (CID), or Criminal Investigation Command, is the investigative branch of the U.S. Army. With less than 2000 soldiers and civilians along with close to 900 special agents working on its behalf, the CID works diligently to investigate any serious crimes which may be of interest or consequence to the Army and its operations.

While the CID is responsible for investigating and ultimately obstructing serious crimes that could affect the Army, they are not responsible for charging individuals with a criminal offense, nor do they work to defend the rights of members of the Army who have been accused of committing a crime. CID is tasked with investigating cases of sexual assault, armed robbery, computer crimes, drug crimes, war crimes, unexplained deaths of soldiers and various other felony offenses. When CID has completed an investigation, they will turn over their documentation and evidence to the appropriate authorities.

If you are under investigation by CID or you have been accused of committing a criminal offense, there is a strong possibility that you will be called to appear before a court-martial or at an Article 32 hearing. The counsel you chose to represent you in these types of circumstances will have an unequivocal impact on the outcome of your case. You do not have to avail yourself of counsel which has been provided by the same military that filed criminal charges against you, when you can hire a civilian attorney with military experience to represent your interests and help you significantly improve your chances of being able to receive a favorable outcome in your case.
